...Powell view, which seems to be supported by Justices Burger, Rehnquist and Blackmun, apparently needs only one more backer, and Stewart, Stevens and White seem to be strong possibilities. If any or all of them join Powell, two results seem nearly certain. First, the extensive use of habeas corpus will be significantly cut. Second, virtually no habeas challenges seeking application of the exclusionary rule will be allowed, since such evidence is almost always proof of guilt, not innocence...
...Amendment that only rarely have they tried to deal with the conflict between a free press and fair trial by ordering reporters not to print information. In recent years, however, a few court decisions suggested that the legal winds were shifting. Then, last November, Supreme Court Justice Harry A. Blackmun refused to void key parts of a Nebraska judge's order that barred the press from reporting the alleged confession of a suspect about to be tried for a grisly multiple murder. ...Justice Harry Blackmun's 67th birthday, and all his colleagues on the U.S. Supreme Court had gathered in their private dining room to raise a glass of wine and sing Happy Birthday. Then, when the song died down, Chief Justice Warren Burger called for attention. But Powell has at times made the foursome a threesome; and with Blackmun more of a question mark, Burger and Rehnquist are now the most certain votes on the right. The liberals-William Douglas, William Brennan and Thurgood Marshall-remain in general agreement. And, to be sure, they are still...
...with White, Stewart, Powell and Blackmun now all occasional members of the searching middle, the court is increasingly unpredictable. "It can make for some very sloppy law," says Stanford Constitutional Expert Gerald Gunther. "But in the long run I think it is a healthy sign, because it reflects the fact that some judges are engaged in a serious effort to rethink difficult problems. You need a breaking up of rigid lines before you can come up with a coherent set of rules for new questions...
