TIME has learned, though, that the arrests were a frame-up to placate the U.S. According to "official sources" cited by Guatemalan newspapers, the police were led to the killers' trail largely by the testimony of one witness: Sister Ana Maria Gonzales Arias, a Mexican nun working as a missionary in Santiago Atitlán. Sister Gonzales was said to have told officials that she saw "various armed men" wearing hoods enter the church, where they were discovered by Father Rother apparently while they were "seeking to rob the church's money...

...Hardcore, Schrader seems unable to get very far beneath the ugly surface of the demimonde. It is clear he is horrified (or at least titillated) by his movie's milieu, but he doesn't make it palpable. In any event, Schrader's development of the frame-up story is mechanically melodramatic, and Gere, essentially a boring actor, doesn't help much either. He just cannot carry a picture, even when his passivity and gentleness well serve some aspects of his character, as they do here...

From the start, the case had the ingredients of a Hollywood whodunit. But when the defense, claiming a frame-up, demanded to see the reporter's notes, the Doctor X trial was transformed into a clash of constitutional principles as well. Citing the First Amendment and a New Jersey "shield law" giving a reporter the privilege of refusing to disclose confidential sources, Farber and the Times refused to turn over anything. The result: a head-on collision between the First and Sixth Amendments, between the constitutional claims of free press and fair trial...

...prosecution witnesses was Dr. Sanya Lipavsky, a KGB agent provocateur who had apparently worked a classic frame-up on Shcharansky. First, Lipavsky had volunteered his services to CIA agents at the American embassy in Moscow. U.S. intelligence sources have conceded that Lipavsky worked for the agency for nine months, providing information about dissidents. After he was dropped by the Americans, who belatedly suspected his KGB connection, Lipavsky shared a flat with Shcharansky for a short time. He thus provided the link the KGB sought to establish between the hapless Shcharansky...

...Soviets registered their first public reaction to the defection by claiming that Shevchenko was being held in the U.S. "under duress." Echoing a Tass dispatch from Moscow, the Soviet Mission to the U.N. issued a statement calling the defector a victim of "premeditated provocation" and of a "detestable frame-up" by American intelligence agents...
