Those setbacks for the President occurred under the pressure of rising public protests from members of Congress against what appeared to them to be legalistic maneuvering by the White House to withhold evidence. What Jaworski Wants. If the White House fails to supply the evidence, Jaworski will almost certainly petition the Washington federal court this week to enforce the subpoena. This could touch off another round of court fights similar to those last summer, when Nixon tried to withhold subpoenaed tapes and papers sought by Archibald Cox, the special prosecutor whom Nixon fired for persisting in demanding evidence. ...Horovitz deceived the public, and the wisdom of the proposed penalty, not the wisdom of revealing the truth, should be at issue. I believe that full airing of truth is in itself a paramount social good and only in exceptional circumstances far removed from this one would I withhold the facts.
