The point made in the letter is that judges should be instructed "to render their decision not on the merits of the question as debated but on the merits of the debating entirely." His objection to the present system is that "in judging the merits of the question as debated" the judges must unconsciously be influenced by their personal prejudices, and that moreover it is almost impossible to obtain a question that will furnish equal opportunities to both sides...
